Terms of Service

1) Acceptance

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) Eligibility

You must be at least 20 years of age, which is the minimum age we apply for our social casino entertainment in New Zealand. The Service is not for minors. You are responsible for ensuring your use is lawful where you are located.

3) Social casino; no real-money gambling

The Service does not offer real-money gambling. Virtual coins/tokens have no cash value and cannot be redeemed, withdrawn, or transferred for real money or real-world items. No prizes of real-world value are awarded. Gameplay outcomes do not imply future results.

4) Accounts

• You are responsible for activity on your account and for keeping credentials secure.
• Provide accurate information and keep it updated.
• We may suspend/terminate accounts for violations, suspected fraud, or security reasons.

5) Acceptable use

• Do not cheat, exploit bugs, automate play (bots), or manipulate the Service.
• Do not harass others or post unlawful, infringing, or harmful content.
• Do not reverse engineer, scrape, or interfere with security or operations.

6) Virtual currency and items

Virtual currency/items are licensed, not sold. They are for entertainment use only on the Service, are non-transferable, and may be modified or removed as required for balancing, compliance, or technical reasons. No refunds are provided for unused virtual currency/items unless required by law.

7) In-app purchases & billing

Optional purchases may be offered to acquire virtual currency/items. Prices and availability may change. Purchases are generally final and non-refundable except where required by applicable law or platform policies (e.g., Apple/Google). You are responsible for taxes and for reviewing your platform/payment account settings.

8) Intellectual property; copyright notices

The Service, software, and content are owned by Moana Online Gaming Limited or its licensors and are protected by the Copyright Act 1994 (NZ) and other applicable intellectual property laws. If you believe content on the Service infringes your copyright, send a notice to contact@moanaonlinegaming.com that identifies the work, the location/URL of the allegedly infringing material, your contact information, a good-faith statement, and your signature.

9) Disclaimers

The Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation or that virtual currency/items will always be available.

10) Limitation of liability

To the maximum extent permitted by law, Moana Online Gaming Limited will not be liable for indirect, incidental, consequential, special, or punitive damages, or loss of data, profits, or goodwill. Our total liability for any claim will not exceed the amount you paid to us (if any) in the 12 months before the claim.

11) Disputes; governing law

These Terms are governed by the laws of New Zealand, including the Gambling Act 2003, the Consumer Guarantees Act 1993, and the Fair Trading Act 1986, without regard to conflict-of-law rules. Where a dispute cannot be resolved informally, smaller claims may be brought before the Disputes Tribunal of New Zealand, and other disputes will be subject to the exclusive jurisdiction of the courts of New Zealand, unless applicable law provides otherwise. Nothing in these Terms limits any non-excludable rights you have as a consumer under New Zealand law.

12) Changes & termination

We may update these Terms by posting a revised version and updating the effective date. We may modify, suspend, or discontinue the Service at any time. You may stop using the Service at any time.
